We would be privileged to give you or your family more information about your legal rights. To learn more about our law firm, you can watch video of what some of our clients in mesothelioma cases have said about LPK (www.lpklaw.com/testimonials.php)or read below (the last names have not been included to respect the privacy of our clients):
Karen (her father an auto mechanic who was diagnosed with mesothelioma at the age of 62):
"They were great attorneys. We could call them at any point. They would always return our phone calls... They cared very much about our case... The jury awarded my father $3.4 million dollars... Levy Phillips & Konigsberg, in my opinion, is a great law firm. The one attorney who started our case ended our case; he was always anytime we needed him. That's the kind of law firm you need - someone who is going to stand up for you and not what's easier for them."
Marlene (her father was a welder who was diagnosed with mesothelioma at the age of 57):
"Our experience with Levy Phillips & Konigsberg was very positive. We would recommend anyone who is considering pursuing a case to use them as their advocates because they will fight for you, they will treat you as equals, they will make sure you are treated with respect and our compensated with what you deserve.... They were extremely supportive, they were extremely caring, they were completely prepared and meticulous to every detail to mounting the case. I would have no reservations in recommending them."
The decision to file a lawsuit is a personal one. Most families who file a mesothelioma lawsuit have never filed a lawsuit before. They are hard-working people that always worked hard all their lives. Many thousands of families in the United States have made the decision to file a mesothelioma lawsuit for two important reasons. First, it is important to hold the companies accountable for the wrongdoing that led to a loved one being diagnosed with mesothelioma. Families affected by mesothelioma should have hope and they should also have justice. Basic fairness demands that companies be held responsible for failing to warn about asbestos and causing a loved one to become ill. Second, it is important for families to receive the financial compensation that they deserve. Although money will never fully compensate families affected by mesothelioma, it can give families the financial security they deserve.
Once again, it is helpful to hear the words of Karen and Marlene – from two families LPK was honored to help – as they explain the decision that their families made to file a mesothelioma lawsuit. Karen:
"My father never filed a lawsuit before. Everything he had he worked hard for all his life. And he was diagnosed with mesothelioma and he decided he needed to find a way to take care of his children and his grandchildren. And he decided to file the lawsuit. We wanted the companies who put the asbestos in the products to be held accountable for my father dying. Everybody needed to be warned and be told what happens when you're around this stuff... If my father didn't file the lawsuit, for one, I don't know where I'd be.... He took care of all of us... By my father filing this lawsuit, we are all a lot better off."
Marlene:
When my father was diagnosed with peritoneal mesothelioma he asked the surgical oncologist what it was due to, that's when he was told it was due to asbestos.... He felt extremely betrayed because they never told him that it was eventually going to harmful to his health. He had always been in good health.... So when he found out that he had cancer and it was due to asbestos – and all these years working with these products, and never knowing it was harmful to his health, and that he could have protected himself – he felt that they were very nefarious. It is very important, I think, to hold these companies accountable for what they did."
Companies that made asbestos products should be held accountable because they knew or should have known about the hazards of asbestos for more than 100 years. Yet, they failed to provide warnings to alert the public of the dangers of asbestos. The time line below is a summary of some of the history of what these companies knew or should have known about the hazards of asbestos:
1899: First published report of disease in asbestos workers.
1918: Articles continue to be published showing disease among workers exposed to asbestos. U.S. Bureau of Labor Statistics publishes report stating that insurance companies were hesitant to sell life insurance to asbestos workers.
1924: British Medical Journal publishes report about a woman who died from lung scarring at 33 after working in an asbestos factory since age 13.
1927: Published article refers to "asbestosis" as a potentially fatal lung disease.
1928: Editorial on asbestosis published in JAMA - the most popular medical journal in the U.S.
1930: Published articles recommend dust control measures including respirators to protect against asbestos exposure.
1932: British government publishes list of products known to give rise to asbestosis.
1940s: Asbestos linked with lung cancer.
1950: At least 80 articles discuss asbestos as a potential cause of lung cancer.
1960: Asbestos is a known cause of mesothelioma.
1964: Dr. Irving Selikoff holds conference in New York City to publicize link between asbestos and mesothelioma, many articles on asbestos and mesothelioma presented. One article shows that household contact, or neighborhood exposure, to asbestos can cause mesothelioma.
Despite all of this information, most companies who sold asbestos products provided no warnings about asbestos, or inadequate warnings.
LPK is proud to have helped families recover hundreds of millions of dollars from the companies that put asbestos in products and failed to warn the public.
